Agreement to these terms

By using this website or engaging 2Minds Creative (“2Minds”, “we”, “us”, “our”) for any service, you agree to these Terms & Conditions. If you don’t agree with them, please don’t use this website or our services. These terms apply alongside any separate proposal, quote, or agreement we send you for a specific project — where the two conflict, the specific proposal or signed agreement takes priority.

Our services

We offer content production and marketing services, including but not limited to:

• Production One-Off — a single filming session and edit, delivered as a defined batch of content
• Retainer — ongoing monthly content production, editing, scheduling, and paid campaign management
• Audit — a review of your existing content and marketing performance with recommendations

The exact scope, deliverables, and timeline for any project are set out in the proposal or quote we send you, not on this page.

Consultations & bookings

Discovery calls booked through our website are provided for free and don’t obligate either party to move forward with a project. We use a third-party scheduling tool (Cal.com) to manage bookings; rescheduling or cancelling a call can be done through the link in your confirmation email.

Quotes, fees & payment

• All quotes are valid for 14 days from the date issued, unless stated otherwise.
• Projects typically require a deposit before work begins, with the balance due on delivery or per the schedule in your proposal.
• Fees are quoted in the currency stated on your invoice and are exclusive of any applicable taxes unless otherwise noted.
• Late payments may result in paused work or delayed delivery until outstanding amounts are settled.
• Prices for our services are subject to change, but any change won’t affect a quote or agreement you’ve already accepted.

Cancellations & rescheduling

• For Production One-Off shoots, we ask for at least 5 business days’ notice to reschedule a confirmed shoot date without a fee.
• Cancellations made within 48 hours of a scheduled shoot may forfeit part or all of any deposit paid, to cover costs already committed on our side (crew, equipment, location).
• Retainer clients may pause or cancel their retainer with 14 days’ written notice before the next billing cycle.

Client responsibilities

To deliver on time and on scope, we need you to:

• Provide timely feedback, approvals, and access (to locations, products, people, or brand assets) as agreed
• Ensure you have the rights to any materials, footage, music, or content you ask us to use or feature
• Respond to review requests within the timeframe agreed in your proposal

Delays on your end may push back delivery dates accordingly.

Deliverables & revisions

Final deliverables and the number of included revision rounds are specified in your proposal. Additional revisions beyond what’s included, or changes to the agreed scope, may be billed separately at our standard rates.

Intellectual property & usage rights

• Once you’ve paid in full for a project, you own the final, delivered content and may use it for your own marketing and business purposes.
• We retain ownership of raw, unedited footage, project files, and any pre-existing tools, templates, or systems we use to produce your content, unless we agree otherwise in writing.
• Unless you tell us in writing that you’d like to opt out, we may use the content we produce for you (or excerpts of it) in our own portfolio, website, social media, and marketing materials to showcase our work.
• You’re responsible for making sure any brand assets, music, footage, or other materials you provide to us don’t infringe on anyone else’s rights.

Confidentiality

We treat information you share with us about your business as confidential, and we won’t disclose it to third parties except as needed to deliver your project (for example, to contractors working on your shoot) or as required by law. If you need a formal NDA before sharing sensitive information, just ask.

Limitation of liability

To the extent permitted by law, 2Minds Creative’s total liability for any claim arising from our services is limited to the amount you paid us for the specific project giving rise to the claim. We’re not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities, arising from your use of our services or deliverables.

Force majeure

Neither party is liable for delays or failure to perform caused by circumstances beyond reasonable control, including natural disasters, extreme weather, government action, power or internet outages, illness, or other events that make it impracticable to carry out a shoot or deliver work on schedule. We’ll communicate promptly and work with you to reschedule where this happens.

Termination

Either party may terminate an ongoing engagement (such as a Retainer) with written notice, as set out above. We reserve the right to decline or discontinue a project if a client engages in abusive behaviour toward our team, fails to pay outstanding invoices, or asks us to produce content that is illegal, defamatory, or that we reasonably believe could harm our business or reputation.

Governing law & disputes

These terms are governed by the laws of Indonesia. Any dispute arising from these terms or our services will first be addressed through good-faith direct discussion; if that doesn’t resolve it, the dispute will be subject to the exclusive jurisdiction of the courts of Indonesia, unless your signed agreement with us states otherwise.

Changes to these terms

We may update these Terms & Conditions from time to time. Changes will be posted on this page with an updated “last updated” date, and will apply to projects starting after that date; they won’t change the terms of a project already in progress unless we agree otherwise with you.
